These terms govern your access to and use of epcotec.com (the “website”). They do not govern client engagements: services are provided under separate written agreements (such as a statement of work or master services agreement), which prevail over anything on this website to the extent of any inconsistency.
2. Who we are
The website is operated by Epcotec Pty Ltd (Australia) and Epcotec Ltd (Canada), together “Epcotec”, “we”, “us”. Company registration numbers and registered addresses are published on the contact page once issued.
3. Acceptance
By accessing or using this website you accept these terms. If you do not agree with them, please do not use the website.
4. Acceptable use
You may use this website for lawful, informational purposes. You must not:
- use the website in any way that breaches applicable law or infringes another person’s rights;
- attempt to gain unauthorised access to the website, its hosting environment, or related systems;
- scrape, harvest or mass-copy content, or use automated tools in a way that degrades the service for others;
- misrepresent your identity or affiliation when submitting enquiries.
5. Intellectual property
The content of this website (text, design, graphics, code and the Epcotec brand) is owned by Epcotec or its licensors and is protected by copyright and trade mark law. You may view the website and reference limited excerpts with attribution; any other reproduction requires our prior written consent.
This does not affect intellectual property in work we deliver to clients: ownership of deliverables is defined in each engagement agreement, and our standard position is that clients own the code and infrastructure we build for them.
6. Estimates, quotes and the estimator tool
Prices, timelines and ranges shown on this website (including results from the estimate tool) are indicative only. They are based on limited information, do not constitute an offer or a binding quote, and should not be relied on for budgeting decisions. A binding fixed price is issued only in a written quote or statement of work after discovery, and only that document governs.
7. Portfolio and references
Delivery records in our portfolio are presented in anonymised form; sector descriptors are indicative. Outcomes described are as recorded at the time of delivery. References are available on request, subject to the consent of the client concerned. Past performance is illustrative of capability and does not guarantee any particular outcome for a future engagement.
8. AI tooling in delivery
We use AI tooling as part of our delivery process, under the control and review of named engineers. As described in our privacy policy, client materials are handled under confidentiality and no deliverable reaches a client without human review. Nothing on this website grants you any rights in the third-party AI systems we use.
9. Information, not advice
Content on this website is general information about our services and approach. It is not legal, financial, investment, tax or professional advice, and must not be relied on as a substitute for advice from your own qualified advisers.
10. Third-party links
The website may link to third-party sites and resources. We do not control and do not endorse their content; you access them at your own risk and on their terms.
11. Website availability
We aim to keep the website available and accurate, but provide it “as is”. We may change, suspend or withdraw content or functionality at any time without notice, and we do not warrant that the website will be uninterrupted or error-free.
12. Exclusion and limitation of liability
To the maximum extent permitted by law, including the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) and comparable Canadian provincial consumer-protection legislation, we exclude all implied conditions, warranties and representations relating to this website, and our liability for loss or damage arising from your use of, or reliance on, this website (including indirect, consequential or economic loss) is limited, at our option, to re-supplying the content or paying the cost of re-supplying it.
Nothing in these terms excludes, restricts or modifies any right or remedy you have that cannot lawfully be excluded, restricted or modified, including statutory consumer guarantees under the Australian Consumer Law. Liability arising under client engagements is governed exclusively by the applicable engagement agreement, not by these terms.
13. Indemnity
You agree to indemnify us against losses, costs and expenses arising from your breach of these terms or your unlawful use of this website, to the extent permitted by law.
14. Modern slavery, forced labour, anti-bribery and sanctions
We have zero tolerance for modern slavery and people-trafficking in our operations and supply chains, and we conduct business consistently with the principles of the Modern Slavery Act 2018 (Cth) and Canada’s Fighting Against Forced Labour and Child Labour in Supply Chains Act. We choose suppliers and subcontractors on the same basis.
We comply with applicable anti-bribery and anti-corruption laws, including the Criminal Code (Cth) and Canada’s Corruption of Foreign Public Officials Act and Criminal Code, and with applicable economic and trade sanctions. We do not offer or accept improper payments, and we expect the same of our suppliers and subcontractors.
15. Accessibility
We design and build (including this website) with WCAG 2.1 Level AA as our target standard, because our government and enterprise buyers require it. If any part of this site creates an accessibility barrier, email hello@epcotec.com and we will fix it.
16. Governing law and jurisdiction
These terms are governed by the laws of Australia for users and engagements contracting with Epcotec Pty Ltd, and by the laws of the province of incorporation and the federal laws of Canada applicable there for users and engagements contracting with Epcotec Ltd. You and we submit to the non-exclusive jurisdiction of the courts of the relevant jurisdiction.
17. Changes and severability
We may update these terms from time to time; the “last updated” date above shows the current version, and continued use of the website after changes constitutes acceptance. If any provision is held unenforceable, the remainder continues in force.
